1. Acceptance of Terms

By accessing or using the AIXFIN.IO website or services (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Services.

These Terms apply to all visitors and users of the Services.

2. Description of Services

AIXFIN.IO provides a white-label financial insights platform designed for credit unions and community financial institutions. The Services include spending analytics, subscription detection, alerts, and related financial wellness tools.

The Services are intended to support decision-making and education and do not constitute financial, legal, or investment advice.

3. Eligibility

The Services are intended for use by regulated financial institutions and their authorized representatives. By using the Services, you represent that you are authorized to do so on behalf of such an institution or for informational evaluation purposes.

4. Accounts and Security

Where registration is required, you agree to:

  • Provide accurate and current information
  • Maintain the confidentiality of your credentials
  • Accept responsibility for all activity under your account
  • Notify AIXFIN.IO promptly of unauthorized access

5. Acceptable Use

You agree not to use the Services to:

  • Violate applicable laws or regulations
  • Introduce malicious code or attempt unauthorized access
  • Interfere with service operation or security
  • Reverse engineer or misuse platform components
  • Use the Services for fraudulent, deceptive, or unlawful purposes

6. Intellectual Property

The Services, including software, content, and branding, are owned by AIXFIN.IO or its licensors and are protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Services for their intended purpose.

7. Partner Service Agreements

Financial institutions deploying the platform enter into separate written agreements with AIXFIN.IO governing data processing, security controls, service levels, and commercial terms.

Those agreements control in the event of any conflict with these Terms.

8. Data Protection and Privacy

Your use of the Services is governed by our Privacy Policy, which is incorporated by reference.

AIXFIN.IO is designed as a Zero-Identity-Knowledge processor. We process financial behavior without access to personal identity.

9. Data Ownership and Processing Rights

9.1 Controller and Processor Roles

Partner financial institutions remain the data controllers of all member data.

AIXFIN.IO acts solely as a data processor, processing data on behalf of and under instruction from partner institutions.

9.2 Pseudonymized Transaction Data

  • AIXFIN.IO does not receive names, emails, Social Security numbers, account numbers, card numbers, or addresses.
  • Transaction data is pseudonymized prior to ingestion.
  • AIXFIN.IO does not possess the linkage keys required to identify individuals.

9.3 License to Process

Partner institutions grant AIXFIN.IO a limited, non-exclusive license to process pseudonymized transaction data solely for:

  • Providing contracted Services
  • Improving platform accuracy and reliability
  • Developing and maintaining analytical and machine-learning models
  • Generating aggregated, non-identifiable insights

AIXFIN.IO does not sell transaction data and does not use it for advertising or consumer marketing.

9.4 Derived and Aggregated Outputs

AIXFIN.IO may retain and use aggregated, non-identifiable outputs derived from processing activity to improve the Services and develop platform-level insights, provided such outputs cannot be directly associated with an individual or institution.

10. Confidentiality

Each party agrees to protect the other's confidential information and to use it solely for purposes related to the Services, except as required by law.

11. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

AIXFIN.IO MAKES NO WARRANTIES REGARDING:

  • ACCURACY OR COMPLETENESS OF INSIGHTS
  • UNINTERRUPTED OPERATION
  • FITNESS FOR A PARTICULAR PURPOSE

AIXFIN.IO IS NOT RESPONSIBLE FOR FINANCIAL DECISIONS MADE BASED ON SERVICE OUTPUTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIXFIN.IO SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM USE OF THE SERVICES.

13. Indemnification

You agree to indemnify and hold harmless AIXFIN.IO from claims arising from your misuse of the Services or violation of these Terms.

14. Termination

AIXFIN.IO may suspend or terminate access for violation of these Terms. Upon termination, your right to use the Services ceases.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

16. Changes to Terms

We may update these Terms periodically. Continued use of the Services constitutes acceptance of updated Terms.

17. Severability

If any provision is unenforceable, the remaining provisions remain in effect.
